Don't put your luggage in the back seat of the car... you could get fined!
Carrying cargo, suitcases, backpacks or boxes on the rear seats of the car can pose a risk, so anyone who does so risks a fine.

When we plan a trip to enjoy a holiday, take a weekend getaway or go on a business trip, we sometimes don’t realise that we may be carrying more luggage than fits in the boot. In that case, the rear seats are often used to place suitcases and the rest of the luggage that doesn’t fit. And although this is very common, it can result in a fine of up to 200 euros.
The reason is simple. Any loose object in the rear seats can become a projectile if there is an unexpected sudden stop. In that case, what is known as the “Elephant Effect” occurs, which means that a small object can multiply its weight several times over and turn into a projectile that can become very dangerous.

Because of this, even a bottle of water can be dangerous if it is loose and turns into an uncontrolled projectile. A suitcase, bag or backpack that is not properly secured can cause serious injuries if it strikes the occupants of the front seats. So, if a Guardia Civil Traffic officer stops you, they may consider that these unsecured objects pose a risk and issue a fine.
It is important to secure all these objects to the seats, if they must be used. One way is to use the seat belts to hold them in place. This way, they can withstand a sudden stop and will not become those potentially harmful projectiles. Furthermore, if you are going to fold down the rear seats, it is better to fold them only halfway. This way they offer some protection in the event of a sudden stop.
There are several items that help carry cargo that doesn’t fit in the boot, such as roof boxes for the vehicle, which should always be used whenever possible and necessary. We are going to offer you some tips to avoid being fined for this reason, even if you have to place cargo outside the boot.
- Organisation is essential: Try to place the heaviest objects at the bottom of the car. On top of them, place the lighter ones. This balances the vehicle and prevents cargo movements that could destabilise the car.
- Do not place loose objects on the parcel shelf: An object on the parcel shelf will be thrown forward if there is a sudden stop. Anything placed there must go on the floor, provided it cannot go in the boot.
- Secure the roof box properly: If you have to install a roof box or a bike rack, make sure it is firmly fixed. If you notice that it moves even slightly, it is not properly fitted. Make sure it is secure and correctly positioned.
- Gather all the small items and put them in a box: This way, they will all be together and secured. The box can go in the boot or on the floor at the back, between both rows of seats.
- Rent a van: If you think you can safely transport everything you need, consider renting a van for the trip. You will avoid problems and gain in safety.
