2021 has got off to a fairly busy start in terms of new traffic regulations. So far, four have come into force, but more will be introduced gradually. In addition, a few days ago we told you what the new speed limits will be from 11 May. We review the changes to the regulations and bring you the four new traffic rules that are already in force.

Pere Navarro and his team have a clear goal: to make 2021 a year with the fewest possible road casualties. To achieve this, they will focus their efforts on the main causes of accidents: speeding and distractions. These are the four new traffic rules that are already in force.

Fine and loss of points for using a mobile phone

This is one of the four new traffic rules that have already come into force. It is one of the most talked-about, as it toughens the penalties for using a smartphone while driving. The fine amounts to 1,500 euros and the loss of six points on your driving licence. In addition, officers will fine drivers holding a phone in their hand 500 euros and deduct six points. Until now, the fine was 200 euros and four points.

Use of seat belts

The fines for those who drive without a seat belt or child restraint systems are 2,200 euros and the loss of four points from the driving licence. Now, improper use of them can also be penalised.

Avoid radar detectors

Penalties rise to 3,200 euros and three points for having a radar detector installed. Under the new regulations, it is enough for an officer to notice the device for a fine to be issued. The device does not need to be switched on.

You may not exceed the speed limit when overtaking

It is no longer permitted to exceed the maximum speed by 20 km/h when overtaking on secondary roads. If you do, you could be penalised. Pere Navarro has stated that this measure is based on these four arguments:

  • 80% of fatal accidents occur on secondary roads, mainly due to speeding and/or distractions.
  • Allowing speeds to be exceeded by 20 km/h encourages drivers to go over the limits.
  • Exceptions make it harder to communicate that speed is one of the main risk factors.
  • Risk of head-on collisions at higher speeds.
